1. Acceptance

These Terms of Service ("Terms") are an agreement between you and LIFEX TECHNOLOGIES LLC ("we", "us") covering your use of the Carbo-AI iOS app and related services (the "App"). By downloading, opening or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Your use of the App is also subject to our Privacy Policy and to Apple's standard End User Licence Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, which applies as the licence terms for the App.

2. Eligibility

You must be at least 16 years old to use the App. By using it, you confirm that you meet this requirement. The App is available on iOS only.

3. Account

You need an account to use the App. You create one with Sign in with Apple.
You are responsible for keeping your Apple ID secure and for activity that happens under your account.
Please give accurate information, and let us know at support@carboai.app if you believe your account has been used without your permission.
One account is for one person. Do not share your account or let someone else use it.

4. Subscriptions

Some features require Carbo-AI Pro, an auto-renewable subscription offered in monthly and yearly options.

Price: prices are shown in the App Store for your region and are displayed in the App before you purchase.
Payment: payment is charged to your Apple ID account when you confirm the purchase.
Auto-renewal: the subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. Your Apple ID account is charged for the renewal within 24 hours before the period ends.
Managing and cancelling: you can manage or cancel your subscription in iOS Settings → your Apple ID → Subscriptions. Deleting the App does not cancel the subscription.
Free trials: if a free trial is offered, its length and terms are as stated in the App Store listing. Unless you cancel before the trial ends, it converts to a paid subscription and you will be charged.
Refunds: purchases are made through the Apple App Store, so refunds are handled by Apple according to Apple's policies. We cannot issue refunds for App Store purchases directly.

We confirm your subscription status through the App Store in order to unlock Pro features. We never see your payment card details.

5. Acceptable use

When using the App, please do not:

Break the law, or use the App to harm or harass anyone.
Upload photos of other people without their consent, or images containing other people's private or sensitive information.
Attempt to reverse engineer, decompile, or interfere with the App or our servers, or bypass security or usage limits.
Use automated tools to access the service, resell it, or abuse the AI analysis feature (for example, with unreasonable volumes of requests).
Try to access another user's account or data.

We may suspend or terminate access if these Terms are broken.

6. Your content

You keep ownership of the photos you take or select and of the meal data you record. They are yours.
By submitting a photo for analysis, you give us a limited licence to transmit and process that photo only for the purpose of providing the analysis you requested, including passing it to the third-party AI provider that performs the analysis on our behalf. The photo is discarded after the estimate is returned and is not stored on our servers.
This licence does not allow us to publish or sell your photos, or to use them for advertising, and it ends when the processing of that request ends.
You are responsible for having the right to submit the images you upload.

7. Health disclaimer

Carbo-AI is a general wellness and food-tracking tool. It is not a medical device and does not provide medical advice.

Nutrition figures produced from photos are estimates generated by an AI model. They can be inaccurate or incomplete, and they should not be relied on where precision matters.
Energy expenditure and carb-plan figures are calculated from the data available to the App and are also estimates.
Nothing in the App is a substitute for advice from a doctor, dietitian or other qualified professional.
Consult a qualified professional before changing your diet, especially if you have a medical condition (for example diabetes or an eating disorder), are pregnant or breastfeeding, or are taking medication.
If you have a medical emergency, contact your local emergency services.

8. Availability and changes

We aim to keep the App available, but we do not guarantee uninterrupted or error-free service. Maintenance, updates, network problems or outages at Apple or at our service providers may cause interruptions.
We may add, change or remove features over time. If we make a material change that reduces a feature you are paying for, you may cancel your subscription as described above.
We may update these Terms. When we do, we will change the "Last updated" date and publish the new version on this page. If you keep using the App after a change takes effect, you accept the updated Terms.

9. Termination and deletion

You can stop using the App at any time. You can delete your account in the App at Settings → Delete account; we then remove your account and all associated server-side data within 30 days, as described in the Privacy Policy.
Deleting your account does not cancel your App Store subscription — cancel that separately in iOS Settings → your Apple ID → Subscriptions.
We may suspend or terminate your access if you materially break these Terms, or if we are required to do so by law. Where it is reasonable to do so, we will tell you why.
If we discontinue the App entirely, we will give reasonable notice where we can.

10. Disclaimers and limitation of liability

To the fullest extent permitted by law:

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the App's estimates are accurate or that the App will meet your requirements.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the App.
Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of the above may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.

Apple is not responsible for the App or its content, and Apple has no obligation to provide maintenance or support for it. Apple is a third-party beneficiary of these Terms and may enforce them against you.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Boston, Massachusetts, and you consent to the personal jurisdiction of those courts. Where mandatory consumer-protection law in your country of residence gives you stronger rights or a local forum, that law continues to apply to you.
